Vibe — Terms of Service (Membership Agreement)

These Terms of Service ("Terms") govern your use of the Vibe mobile application and the vibecadde.com website (the "Platform"). By registering for or using the Platform, you confirm that you have read, understood and accepted these Terms.
The Platform is operated by the party identified below (the "Provider"):

1. Definitions
- User: the natural person who registers for and/or uses the Platform.
- Service: profile creation, discovery, likes/matches, messaging, voice/video calls, stories and all related features for dating/social purposes.
- Content: any photo, video, text, audio or other material created or shared by a User.
2. Membership and Age Requirement
2.1. The Platform is open only to persons aged 18 or over. The declared date of birth is taken as basis; accounts found to belong to persons under 18 may be closed without notice.
2.2. Membership is created via phone-number verification and/or social login (Google, Apple). The User warrants that the information provided is accurate, current and belongs to them.
2.3. Each user may open only one account, for one real person. The User is responsible for the security of the account and for activity carried out through it.
2.4. Profile verification (via selfie) may be requested for platform safety; the visibility of unverified profiles may be restricted.
3. Rules of Use and Prohibited Conduct
The User agrees to refrain from:
- Impersonating others, creating fake profiles or sharing misleading information;
- Sharing obscene, violent, hateful, insulting, harassing or threatening content;
- Sharing nudity/sexual content or any content involving minors;
- Sending unsolicited advertising, spam, fraud or commercial offers to other users;
- Collecting, recording or distributing other users' personal data without permission;
- Engaging in actions that compromise Platform security, using automated bots/scrapers, or reverse engineering;
- Any activity that violates applicable law.
In case of breach, Content may be removed and the account may be suspended or permanently closed.
4. User Content and Licence
4.1. The User represents that they own or have the necessary rights to the Content they share.
4.2. The User grants the Provider a worldwide, royalty-free, transferable, non-exclusive licence to use the shared Content (storage, display, matching, technical processing) for the purpose of providing the Service. This licence ends upon deletion of the Content or closure of the account, except for technical backups and legal obligations.
4.3. The Provider reserves the right to remove Content it deems contrary to law or these Terms, but has no obligation to pre-screen Content.
5. Safety, Blocking and Reporting
5.1. Users may block people they find disturbing and report inappropriate conduct/content. Reports are kept confidential and reviewed within a reasonable time.
5.2. The Provider is not responsible for real-world interactions or meetings between users. Users are advised to exercise caution and take safety precautions when communicating with people they meet.
6. Paid Services, Subscriptions and Purchases
6.1. In addition to free features, the Platform offers Premium membership and add-on packages (e.g. unlimited likes, see who liked you, SuperSwipe, Spotlight, story replies, incognito mode, advanced filters).
6.2. Purchases are made through the Apple App Store and Google Play, subject to those stores' payment systems and rules. Prices are shown in-app.
6.3. Subscriptions renew automatically at the end of each period unless cancelled by the User. Cancellation and refunds are subject to the rules of the relevant store (App Store / Google Play). Cancellation is made through the relevant store account.
6.4. Your withdrawal/refund rights under consumer law are reserved. Where performance of digital content/services has begun, exceptions to the right of withdrawal may apply under applicable law.
7. Freezing and Deleting the Account
7.1. Freeze: The User may temporarily freeze the account. The profile is then hidden from other users, but data is preserved and the account is reactivated upon signing in again.
7.2. Delete: The User may request account deletion. After a 3-day grace period, the account and related data are permanently deleted, except for legally required retention; signing in within the grace period cancels deletion. Any active App Store/Google Play subscription must be cancelled separately through the relevant store.
8. Intellectual Property
The software, design, trademarks, logos and all other elements of the Platform belong to the Provider or its licensors. Users are granted only a limited right of use for personal, non-commercial purposes under these Terms.
9. Limitation of Liability
9.1. The Service is provided "as is". The Platform does not guarantee that users will match, meet or achieve any particular outcome.
9.2. To the extent permitted by applicable law, the Provider is not liable for damages arising from user Content, interactions between users, or third-party services (payment systems, call infrastructure, etc.).
9.3. No liability arises in cases of force majeure or interruptions beyond the Platform's control.
10. Changes to the Terms
The Provider reserves the right to amend these Terms. Material changes are announced through the Platform or by an appropriate method. Continued use after changes take effect constitutes acceptance of the updated Terms.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Türkiye. Disputes are subject to the competent courts, enforcement offices and consumer arbitration committees determined under applicable legislation, in particular consumer protection law.
